1.

IMPORTANT NOTICE INTENDED TO USERS
NWC-EducExpert inc. (hereafter called EducExpert) is pleased to contribute to the improvement of skill through its training modules available on the Internet. To have access to EducExpert's training modules, you must read and accept the following conditions of use. The training presented by EducExpert does not in any case exempt the user from doing the practices, if required, needed to acquire the necessary skill.


2. GENERAL CONDITIONS OF USE
In using the services rendered by EducExpert, the user undertakes:

2.1

To keep confidential and protect the confidentiality of all information gathered, disclosed or transmitted by EducExpert ;


2.2

Not to disclose, communicate or by other way transmit the information given by EducExpert and undertakes not to disclose, communicate or transmit the information unless authorized by EducExpert.


2.3

Not to use, copy or otherwise communicate any information, inquiry, computer software or else made available by EducExpert other than for the use they are intended for , i,e, the training program;


2.4

Limitation of liability and compensation
In order to satisfy its clients, EducExpert used to the most innovative technologies and endeavours to update quickly the information available. Despite the efforts made, EducExpert cannot however guarantee that these technologies and information obtained from different sources are at all times infallible and validated, nor that these informations are totally adapted whatever the conditions and application places are. Consequently, EducExpert informs all users that such technologies and information could be proved to be inaccurate, incomplete, deficient or erroneous. This may be the case without EducExpert having been informed or aware. Consequently, by using the technology and the information available on the Internet via EducExpert, the user recognizes that EducExpert cannot guarantee that this information be available at all times and recognizes that periods of interruption of service could happen despite all means taken for the continuity of service. As such, the user releases EducExpert from any and all liability, direct or indirect, in this regard. As a result of the benefits given by EducExpert, the user agrees that : EducExpert, its directors, employees, officers, representatives, suppliers, partners or sponsors will not in any way be liable of any damage or prejudice, direct or indirect, exemplary or punitive, suffered by the user, his personnel, his learners and/or any other person, no matter how they may be related to the application of the present agreement and/or the content, the use or the application of the e-learning program in fire safety via Internet or other goods and services made available by EducExpert under the present agreement. In any case, no liability can be attributed to EducExpert, in excess of the amount of the fees charged by EducExpert to the user for the specific service concerned. The user also promises and agrees to compensate and hold harmless EducExpert, its directors, employees, officers, representatives, suppliers, partners and sponsors against any lawsuit, loss, claim, demand, cost, penalty and procedure of any kind (including lawyers fees and legal charges) in all cases of limitation of liability provided herein.


2.5

Applicability


2.5.1

The provisions of the present agreement will be interpreted in accordance with the laws of the Province of Quebec;

2.5.2

Any disagreement regarding the present agreement not amicably settled or any eventual legal proceedings between the parties will be initiated exclusively in the judicial district of Quebec (Quebec), Canada;

2.5.3

The fact that any provision of the present agreement be declared null, invalid and/or illegal will not invalidate the present agreement and other provisions will continue to have their full effect;

2.5.4

The user is asked to submit to the EducExpert customer service any suggestion or request he may found to be useful for the use of the products and services offered by EducExpert.
